Gartner Digital Markets Pay-Per-Lead Service (the “PPL Service” or the “Service”) is a web-based lead generation service where advisors deliver leads that are (i) customized for the Vendor through a rigorous needs analysis and qualification process; and (ii) compliant with applicable data privacy laws and regulations. For the avoidance of doubt, Gartner Digital Markets secures the necessary consent to share buyer contact details as a lead with the Vendor(s), after which it is Vendor’s responsibility to manage buyer contact details in accordance with its own policies.

In this Service Description references to “we”, “us” or “Gartner Digital Markets” are references to the Gartner, Inc. subsidiary company that is party to the General Vendor Terms in the Vendor’s location, on behalf of the affiliate companies composing the Gartner Digital Markets group: Capterra Inc., Nubera eBusiness S.L. (d.b.a. GetApp) and Software Advice, Inc. References to “Vendor” or “you” or “your” are references to the Company purchasing the PPL Service. All capitalized terms not defined herein are defined in the Glossary (see https://www.softwareadvice.com/legal-page/definitions-glossary/).

Eligibility

To be eligible to receive the PPL Service, Vendor must adhere to the policies, terms, and conditions set forth herein and the for your country, the Profile Guidelines, and the , and ensure timely payment of invoices in line with the terms set forth below and in any applicable insertion order or similar transaction document (each, an “IO”).

Additional Terms & Conditions to Eligibility

  • Maintain a sales team that responds to leads in all applicable time zones based on your geographical lead criteria (e.g., if you accept U.S. leads, your sales team can respond within U.S. business hours).

  • Have a U.S.-based, Canada-based, or toll-free phone number.

  • Provide all product information necessary for our advisor team to successfully match your product(s) to actively searching buyers.

Access

Access to the PPL Service is provided through the Gartner Digital Markets account (“your account”) to Vendor’s designated users (“Users”) via personalized login credentials (i.e. username and password). Users are wholly responsible for safeguarding their credentials. Users with Admin permissions may create, remove, and manage the access levels of users. Vendors may create user credentials for 3rd parties when authorized by Gartner Digital Markets.

Deliverables

An account using the PPL Service entitles Vendor to the following:

  • A summary of your lead criteria (e.g. company size, industry, country, etc) for advisors to match buyers to your product(s).

  • The ability to set a schedule for advisors to book meetings for leads with members your sales team (see Scheduling/Appointment Setting section below).

  • The ability to manually place bids for leads by market and size band.

  • The ability to purchase Expansion Leads, when available.

  • A downloadable summary of all leads purchased.

  • The ability to opt in to CRM Integration to have leads delivered directly into your CRM for faster response times and better internal reporting (see CRM Integration section below).

  • Access to support.

  • Email delivery of leads purchased that match your lead criteria. 

  • Email delivery of Expansion Leads purchased. (see Expansion Leads section below).

  • The ability to update copy and images on your Profile, in accordance with the Profile Guidelines.

Scheduling/Appointment Setting

Scheduling enables advisors to book meetings for buyers with members of your sales team. When we successfully schedule a meeting between you and the buyer, we add a 50% fee to the lead cost. If the buyer cancels or does not attend the appointment, and rescheduling is not possible, we will refund this additional fee.

Expansion Leads

An Expansion Lead is a qualified buyer that matches most but not all of your lead criteria. If you purchase an Expansion Lead, you will be able to view the buyer's full contact information in your account, and the lead will be sent via email and CRM, if enabled. 

The buyer will receive an email notifying them to expect a call from your organization, which will include your website, sales phone number, and a link to your Profile.

CRM Integration

A CRM Integration enables us to send lead details directly to your CRM system, in addition to email. You can authorize this integration through your account. There is a fee of $2.95 per lead for the CRM integration. Once requested, the integration will be added to our development team's queue for building, testing, and deployment.

Bidding and Budgets

Your monthly budget and bidding strategy allows you to influence the volume of leads you receive and impacts your product’s placement on advisor recommendation lists. 

You set a monthly budget for leads, which is the maximum amount you are willing to pay for leads in any month. Your budget can be adjusted at any time upon request but cannot be set below a given month’s incurred spend. Due to the nature of the Service, we cannot guarantee lead quantities but will ensure that Service is paused once your specified Budget has been met. Vendors may also choose to set an Unlimited Budget, where there is no cap on the number of leads received in a given month.

Your bid is the price you are willing to pay for each lead. You need to place a bid for every combination of market and company size band where you want advisors to recommend your product to buyers. The cost of a lead is determined using an auction. The auction ranks all the bids from various vendors competing for the lead.

Leads are priced on a cost-per-lead (CPL) basis according to market value and the bids you set. Additional fees will be applied for Scheduling/Appointment Setting and/or CRM Integration.

Payment Terms

For the PPL Service, Vendor shall be responsible for all fees resulting from Vendor’s bids set and the resulting leads received from the time a campaign is started until the campaign is turned off. Vendor shall pay all fees in accordance with the payment terms set forth in the .

Termination

Vendor or Gartner Digital Markets reserves the right to cancel the Service at any time without penalty, provided that they provide to the other party notice of cancellation by email including a reason for cancellation. Vendor’s email must be confirmed by Gartner Digital Markets. Cancellation will occur within two business days of receipt of cancellation email once these requirements have been met.

For Vendor, all outstanding fees for lead activity up until cancellation must be paid immediately upon cancellation. Vendor is also responsible for any collections fees incurred through Gartner Digital Markets’ attempts to collect on the account.

Gartner Digital Markets may terminate Vendor’s access to the Service for any reason upon 90 days prior written notice. 

All outstanding fees must be paid before Vendor may reactivate services.

Refunds and Credits

Vendor is eligible for lead refunds under the terms and conditions set forth in the PPL Refund Policy.

We reserve the right to update this Service Agreement periodically to account for changes in our offerings and policies. Your continued use of the Service constitutes your agreement to the updated terms. Use of this Service is governed by the terms of this Service Description, the General Vendor Terms for your country, the Profile Guidelines, and the Community Guidelines.
